Terms of Service

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for all activity on your account and for keeping your credentials confidential. Notify us immediately of any unauthorised access.
• One person or legal entity may not maintain more than one free account. We reserve the right to suspend or terminate duplicate or abusive accounts.
• If you create a workspace on behalf of a company, you represent that you have authority to bind that company to these Terms.

You agree not to:

• Use the Services in violation of applicable law, including data-protection, anti-spam, real-estate licensing, and consumer-protection laws.
• Upload personal data of third parties (e.g. leads, clients, contacts) unless you have a lawful basis to do so, and respond to any data-subject requests they raise to you.
• Send unsolicited bulk communications, chain letters, or any form of spam through the Services.
• Reverse-engineer, decompile, or attempt to extract the source code of the Services (except where permitted by law).
• Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure, without prior written permission.
• Use the Services to build a competing product, train machine-learning models on our aggregate data, or scrape platform content at scale.
• Upload viruses, malware, or any code designed to disrupt or damage the Services or other users.
• Impersonate any person or misrepresent your affiliation with any entity.

You retain all ownership rights in the content you submit to the Services ("Your Content"), including CRM records, photos, files, and notes. You grant MyBrokery Technologies LLC a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and create technical copies of Your Content solely to operate and improve the Services.

You represent and warrant that you have all rights and consents necessary to upload Your Content and that it does not infringe any third-party rights or violate any law.

• Paid plans renew automatically at the end of each billing period (monthly or annual) at the then-current price. You can cancel at any time from the Billing settings; your plan will remain active until the end of the current paid period.
• All fees are charged in the currency stated at checkout and are exclusive of taxes (VAT, GST, sales tax) unless stated otherwise. Applicable taxes will be added at checkout based on your billing address.
• Payments are processed by Stripe. By providing payment details you authorise us (via Stripe) to charge your card for all amounts due, including renewals and add-ons.
• Except where required by law (e.g. EU/UK 14-day right of withdrawal for consumer purchases) or expressly stated in our refund policy, fees are non-refundable. Partial periods are not refunded on cancellation.
• If a payment fails, we may suspend access until the balance is settled. Repeated failures may result in account termination and deletion of data after the grace period.
• We may change prices with at least 30 days' notice. The new price applies on your next renewal.

If you obtain the MyBrokery mobile app through the Apple App Store or Google Play, your use is also subject to that store's terms. In-app purchases of digital subscriptions made through the App Store or Play Store are billed and refunded by Apple or Google according to their policies, not by us.

Free trials are limited to one per company and may be ended at our discretion. If you do not cancel before the trial expires, you will be charged for the plan you selected. Free plans may have feature, seat, or storage limits and may be discontinued or changed at any time.

The owner of a workspace controls who may join it, what roles they hold, and what data they can see. Workspace owners are responsible for the actions of their members within the workspace. Members agree to these Terms upon joining.

• You may terminate your account at any time by following the deletion flow in settings. After deletion we retain data only for the period necessary to satisfy legal obligations or resolve disputes (see Privacy Policy section 9).
• We may suspend or terminate your access immediately if you breach these Terms, fail to pay, or use the Services in a way that endangers other users or our infrastructure.
• Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

The Services, including all software, design, trademarks, and content created by us, are owned by MyBrokery Technologies LLC and protected by intellectual-property laws. Nothing in these Terms grants you any right in our intellectual property except the limited right to use the Services as set out here.

The Services may integrate with third-party products (e.g. email providers, payment processors, map providers). Your use of those products is governed by their own terms. We are not responsible for their availability or content.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE PRESERVED WITHOUT LOSS. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF IMPORTANT DATA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MYBROKERY TECHNOLOGIES LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) USD 100.

Nothing in these Terms excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or fraud).

You agree to indemnify and hold harmless MyBrokery Technologies LLC from any claim, loss, damage, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right (including any claim by a person whose data you uploaded).

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles. The courts of Dubai will have exclusive jurisdiction over any dispute arising from or relating to these Terms, except where mandatory consumer law gives you the right to sue in your country of residence.

We may modify the Services at any time, including adding, removing, or changing features. We may also revise these Terms; material changes will be notified by email or in-app banner at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

• Entire agreement — these Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and us about the Services.
• Assignment — you may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Severability — if any provision is held unenforceable, the remaining provisions remain in full force.
• No waiver — our failure to enforce any right is not a waiver of that right.
• Notices — we may give notice through the Services or by email to the address on your account.
